On 17 October 1939, songwriters Carl Field, Henry Clarkson and Jeff Clarkson filed suit in the Federal Court in Los Angeles for alleged song plagiarism against 20th Century-Fox Film Corporation, Con Conrad, Herb Magidson and the Sam Fox Publishing Company. Their suit claimed that the song, "Here's To Romance", from the 20th Century-Fox film of the same name, fringed upon the plaintiff's song, "Goodbye to Love".
